Time to update Screen Industry Contracts

The Screen Industry Workers Act 2022 came into effect on 30 December 2022.

The Act required certain mandatory terms in individual contracts, including:

  1. An obligation on the parties to the contract to comply at all times with their respective obligations under the Health and Safety at Work Act 2015 and the Human Rights Act 1993. 

  2. A plain language description of the process by which the screen production worker may raise a complaint about bullying, discrimination, or harassment in the workplace; including a statement that the process does not prevent the screen production worker from raising a complaint under the Act or any other enactment. 

  3. A plain language explanation of the processes available for resolving disputes. 

  4. The period of notice (if any) required if either party to the contract terminates the contract; and the compensation (if any) payable to a screen production worker if the party who terminates the contract is the worker’s engager. 

Under schedule 1 (Transitional Provisions) all contracts entered into before commencement of the Act are required to contain the same mandatory provisions by 30 December 2023.
