Otherwise a working day

As a guide, a particular day of the week would otherwise be a working day for an employee if the employee has worked on 50% or more of the corresponding days in either the previous 4 weeks or the previous 13 weeks. 

The above aligns with the output of the Holidays Act Working group which the Government has said it will adopt. 

Good Friday - 2 April (This day does NOT transfer)

  1. If the employee usually works on a Friday (determined as above) and they work on 2 April they are entitled to T1.5 for the time worked, plus an alternative holiday.
  2. If the employee usually works on a Friday but they do not work on 2 April they are entitled to be paid their relevant daily pay for the day, but no alternative holiday (because they’ve had a holiday).
  3. If the employee does not usually work on a Friday and they work on 2 April they are entitled to be paid T1.5 for the time worked, but no alternative holiday (because that is not a day they usually work).
  4. If the employee does not usually work on a Friday and they do not work on 2 April they are not entitled to any payment. 

Easter Monday - 5 April (This day does NOT transfer)

Same as above – ie:

  1. If the employee usually works on a Monday and they work on 5 April they are entitled to be paid T1.5 for the time worked, plus an alternative holiday.
  2. If the employee usually works on a Monday but they do not work on 5 April they are entitled to be paid their relevant daily pay but no alternative holiday (because they’ve had a holiday).
  3. If the employee does not usually work on a Monday and they work on 5 April they are entitled to T1.5 for the time worked, but no alternative holiday (because that is not a day they usually work)
  4. If the employee does not usually work on a Monday and they do not work on 5 April they are not entitled to any payment. 

Easter Sunday - is NOT a public holiday

ANZAC Day (This day DOES transfer)

This year 25 April is a Sunday:

  1. If the employee usually works on a Sunday and they work on 25 April that is their public holiday and they are entitled to be paid T1.5 for the time worked, plus an alternative holiday.
  2. If the employee usually works on a Sunday but they do not work on 25 April they are entitled to be paid their relevant daily pay but no alternative holiday (because they’ve had a holiday).
  3. If the employee does not usually work on a Sunday for them the public holiday transfers to Monday 26 April, then:
    • If the employee works on Sunday, 25 April they are entitled to be paid their normal rate for the time worked, but no alternative holiday.
    • If the employee works on Monday, 26 April they are entitled to be paid T1.5 for the time worked, plus an alternative holiday.
    • If the employee does not work on Sunday, 25 April they are not entitled to any payment for that day.
    • If the employee does not work on Monday, 26 April that day is their public holiday and they are entitled to be paid their relevant daily pay for the day but no alternative holiday (because they’ve had a holiday). 

Note: For clarity, an employee who works on both Sunday and Monday is entitled to only one public holiday.
